Do I need a worker's compensation Insurance for my deli? ? Poly ...

I?m planning to start a deli.Me,my wife and a part time employee will be working there. I?m not planning to put either me or my wife on payroll. So the only person on the payroll will the part time employee.
Now i?m shopping around for liability insurance. Some of the agents says I have to have worker?s compensation insurance as well. Do I really need that? I live in NJ

Some questionable advice, above, so pretend you did not read any of it, and follow along.

You are required to carry WC if you have 1 or more employees. The definition of employee is anyone who is the "servant" in a master servant relationship. The hours they work have nothing to do with it, nor does the amount or type of payment.

Evidently, you are operating as either a partnership or a sole proprietorship. You as owner are automatically EXCLUDED from coverage, but may optionally elect to be covered. If you want coverage for yourself, then you will be assigned a payroll for rating purposes, regardless of what you actually make. As of year end, 2011, you will be charged based on actual earnings subject to a minimum of $29,640 and a maximum of $118,040.

Same deal with partners, and members of an LLC.

If you are a corporation, however, then executive officers are automatically INCLUDED, but may elect to be EXCLUDED. Same minimum and maximum payroll assignments as above.

Be aware that your "remuneration," typically means "payroll," but includes many other forms of consideration, as well ? not just the paycheck.

Your best bet is a consult with an accountant and/or attorney who is familiar with business law and can help you establish a business format appropriate to your needs.

I?ve given you some links to get you started. Remember, as with everything, "Certain restrictions apply, see store for details."

No. 7 North Carolina beats rival NC State 86-74

(AP) ? For once, North Carolina's offense wasn't all about Kendall Marshall racking up assists by looking to his high-scoring teammates instead of for his own shot.

Instead, the pass-first point guard turned in the best scoring day of his career to go with his latest masterful floor game.

The sophomore had a career-high 22 points and 13 assists to help No. 7 North Carolina beat North Carolina State 86-74 on Tuesday night, extending the Tar Heels' domination of their nearby rivals.

Harrison Barnes added 20 points for the Tar Heels (24-4, 11-2 Atlantic Coast Conference), who beat the Wolfpack (18-10, 7-6) for the 12th straight time. North Carolina hasn't lost to N.C. State since February 2007 and has its longest winning streak in the 99-year history of the series.

Everything started with Marshall.

"I just came in confident," Marshall said. "I feel like any player's going to be much better when they play with confidence."

Marshall found plenty of openings as N.C. State's defense sagged off him to help on Tyler Zeller and John Henson inside. He came in with just three double-figure scoring games all season, but hit 7 of 8 shots and 4 of 5 from 3-point range to provide an unexpected burst of offense.

Marshall also hit all four of his free throws and had no turnovers in 38 minutes.

"Kendall Marshall was something else," UNC coach Roy Williams said. "I can sit up here and nitpick all I want, but he was really, really good."

Behind Marshall, the Tar Heels got off to a strong start in front of a hostile crowd, shot 51 percent for the game and even shook off their outside-shooting struggles by making 10 of 19 3-point shots.

C.J. Leslie had a career-high 24 points to go with 12 rebounds for N.C. State, but the Wolfpack just couldn't keep up.

Barnes reached the 20-point mark for the fourth time in five games, while the Tar Heels had all five starters score in double figures for the first time this season.

"I thought everyone was clicking," Barnes said. "Just off the bat, John makes a shot, Reggie (Bullock) makes a shot, I make a shot, Kendall makes a shot. When you've got four guys taking four different shots and making them all, we're hard to stop. And we did a good job of keeping the pace going."

In last month's first meeting in Chapel Hill, the Tar Heels dominated the entire way and led by 31 points in a 74-55 win. This time, the Tar Heels remained in firm control and turned away several spurts before stretching the lead out in the final 11 minutes.

The Tar Heels ran off nine straight points to take a 71-55 lead on Barnes' jumper over C.J. Williams with 8:18 left. Marshall followed that with another 3 for the Tar Heels' largest lead at 74-56 with 7? minutes left ? signaling yet another UNC win in the series.

"Once he's shooting like that, I don't think anybody can stop him," N.C. State's Lorenzo Brown said of Marshall.

N.C. State has lost to Duke, Florida State and North Carolina in the past week, the three teams that entered the week leading the ACC standings. This might've been the Wolfpack's last chance for a marquee win to help its NCAA tournament chances even as the program has its best league win total in six years.

"We certainly had opportunities to help ourselves, no question," first-year N.C. State coach Mark Gottfried said. "What we have to do now is continue to play really hard and do everything we possibly can and see where we end up."

While the sight of light blue always incites Wolfpack fans, the red-clad crowd in the RBC Center was in a particularly foul mood days after referee Karl Hess ejected former Wolfpack stars Chris Corchiani and Tom Gugliotta from their seats behind the scorer's table during Saturday's loss to the Seminoles.

Not coincidentally, N.C. State athletic director Debbie Yow decided that same day to honor the 1989 team ? Corchiani and Gugliotta were on the squad that won the program's last ACC regular-season title ? before the game to add some extra spice to the already charged home crowd.

But the Tar Heels came out fast with a 10-2 spurt that drained some of that buzz, then answered a push by the Wolfpack that tied it midway through the first half by taking a 46-41 halftime lead.

The Wolfpack never got that close again.

"Just haven't been quite good enough yet to get over that hump at times," Gottfried said. "That's where this team has got to find a way to do that."

Open Up and Bloom - It's Your Choice

It has been said that human beings are the only creatures privileged with the ability to refuse to bloom and open up. Why is that? Why are we privileged in this sense and why do we resist?

We are privileged because as conscious beings we have the power of choice. You can say yes to things or you can say no. You can say yes to Divine Guidance and Wisdom or you can resist and say no. It's your choice. Consider this quote by Rumi: "Who says the eternal being does not exist? Who says the sun has gone out? Someone who climbs up on the roof, and closes his eyes tight, and says I don't see anything." You see, you CAN go to the rooftop and close your eyes tightly - it's your choice. Buy why would you do that? Well, there are a lot of reasons, but a big one may be having been hurt by past experiences of trusting and opening up.

And why do we resist? Because we've been hurt in the past, or experienced other "flavors" of hurt like disappointment and failure. We close down and resist blooming and opening. This is a normal human mechanism for safety and protection that can of course be helpful. We've been hurt before and we don't want it to happen again so we create strategies to prevent it. However, things are always changing, and these automatic mechanisms and strategies can become outdated over time and become more hurtful than helpful.

At some point the resistance to blooming can become so painful that we must choose to bloom! However, before reaching that point, we can help the blooming process by proactively looking at those things that are keeping us closed and resistant. We can look for the outdated strategies that are no longer helpful, and begin to dismantle them and their grip on our life. Doing this important work is step seven of my coaching system, "Let Go of Old, Negative Stuff - Beliefs, Habits, and Patterns."

As soon as someone steps onto their new path toward their new life, what they typically run into are all their old beliefs and habits that have been holding them back. It is vital to understand this and be able to address it. If you are not able to see, work with, release and transform old beliefs and habits that hold you in place, you will very quickly return to your old life and be even more resigned. You may say to yourself that you "tried" and it just didn't work out. You will resist your blooming.

I have dealt with this a lot in my own life and, frankly, I still do. Often I would go to an amazing and inspiring seminar or workshop, come out ready to take on the world, only to find my old habits and ways of being creeping back in over the next few weeks. A month or more out from the workshop it was as if my brain was asking, "what workshop?"

Getting insights and inspiration is important, but is only the beginning. One of the down-side problems relating to weekend workshops and seminars is the lack of long-term support. There is often no process in place to work out the old ways of being that participants took with them into that workshop. There's typically not even an acknowledgement that these things even exist! I'm sure you've experienced this in your own life and know it to be true. Lots of people are offering fascinating and inspiring programs, but what is missing is the follow up. Old beliefs and habits have far more momentum and are far more ingrained than any new idea or inspiration. Without the follow up, most of the new ideas will die on the vine.

Learning how to let go of old negative beliefs, habits, and patterns is THE difference between success and failure. In my opinion this is why people became frustrated with the movie "The Secret." They went out and asked for and believed they could have something. But what they were not told is that there is a huge part of them that does not believe they can have it, or should have it, or deserve it, or that it's even possible. That's what a friend of mine has called "The Dirty Little Secret." The dirty little secret is that when you truly desire something and commit to having it, what comes up for you are all the beliefs or constructs that kept you from having it in the first place. These must be released for true fulfillment to take place.

I know how hard it is to let go of negative beliefs and habits. That is why I created an audio program called "Shift It." This is an easy and powerful tool specifically designed to address negative beliefs and blocks.

I have experienced and worked with MANY different tools and processes for releasing and transforming beliefs and habits we no longer prefer to uphold. The tools and processes that really work have these three things in common:

1) They make you stop and notice what is happening; you become a conscious witness to the FACTS about the situation(s),

2) They invite you to embrace all aspects of your experience of the situation: physical, mental, emotional. You must embrace and allow the truth of your experience - the only way out is through.

3) Once you've gone into the uncomfortable aspects and felt and allowed them, you then open up to new insights and possibilities for your life.

You can think of this generalized process as a bridge between two lands: your current, limited reality/experience, and your desired, expanded reality/experience. The bridge between these two lands is courageously built by embracing and allowing your truth and the full-body experience of the issue, situation, or challenge. Basically, you are consciously embracing all your "fears of what might happen." Once you've done this, it is like magic! New insights and possibilities automatically begin arising.

Try this:

Where are you "tightly closing your eyes" and afraid of seeing the rising sun? Where are you resisting your blooming?

Think of an uncomfortable or frustrating situation in your life right now. Write down one or two sentences that simply describe the facts of that situation. Then, write down how you feel about it; what are all the thoughts, feelings, and physical sensations you experience when you think about this situation? Do you feel angry, mad, tired, resigned, or perhaps sad? Where in your body do you feel these feelings? Point to and describe the physical feelings you are having. It might be tension or tightness, a "sick to the stomach" feeling, a numbness, or perhaps heat or hotness.

Allow yourself to notice and experience these feelings. Fully go into them with an open curiosity, with an attitude of "Wow, look how irritated I am" or "Wow, look how much tension I have around this situation." Just notice and allow whatever is there for you as you think about the situation. This should only take two or three minutes, but take as much time as you need.

Then, once you have embraced and allowed your experience, begin opening up to new insights, ideas, or thoughts that may be arising. Just turn your attention toward "new ways of holding or moving through the situation." You can even ask, "In what new ways might I hold this situation." Then listen quietly for your intuition and insights to arise. In the beginning, a process like this is best engaged with a skilled facilitator. However, with some courage, compassion, and gentleness, you can certainly make some headway on your own.

Helping someone else in need is one of the best stress-relievers, and when you sacrifice something of yourself to help another, you start to realize your full self.

If you are looking for self-help tips to help out with your depression, consider taking a long walk with a friend or family member. It is great to share your thoughts and feelings with someone, and studies have shown that exercise is a great way to help fight depression.

Avoid being a perfectionist. Face it, no one can do everything in a perfect manner every time, and there is no reason to think that you can do everything perfectly. Be okay with middle ground at times and remember, if your boss is happy with your work but you are still worrying about it, you are most likely setting your standards too high. Lower them a bit and enjoy your results.

Acknowledge the positive steps you are taking right now. Completely focusing on the negative makes you feel depressed, and like you can?t accomplish anything. Instead, give yourself credit for who you are, where you?re at, and what you?re striving to be. Giving yourself a pat on the back is important, and you won?t succeed without doing so.
